The area planning procedure (ROV) belongs to the three classical instruments of the regional planning. These are beside the ROV the land development programs and the regional plans in Germany. The legal bases form "ยง15 ROG and the regional planning acts of the countries. The ROV represents a before-clarifying appraisal for the evaluation of the space compatibility of spaceimportant single projects also to over-local meaning (e.g. route guidance of a motorway). It clarifies thereby whether a measure is compatible with the goals and principles regional planning law width unit and like spaceimportant measures be co-ordinated can. The ROV does not have a direct legal effect outward and is not administrativejudicially contestable.

Tasks

A ROV has the task to examine the agreement of the concrete project with the goals and principles of the area planning and the regional planning. It is cross section-oriented and integrated thus economic, ecological, cultural and also social aspects. It is to create planning security for the investor and in the public acceptance for the project. It forms an information - and for evaluation basis for the following procedure of admission.

Expiration

A ROV can be introduced either officially or on initiative of an agency responsible for the project.

First the necessity for the procedure is examined:

  • How are the planning conditions of the area planning and regional
  • Are changes of plan
  • Is a sufficient co-ordination between area planning and regional planning
  • Does a requirement on the ROV

Afterwards the ROV is prepared with the help of national central authorities. The necessary plan documents will become provided and the carriers of public interests involved. In the connection the ROV can be opened by forwarding of the documents formally. In the context of the public participation the plans are then discussed and revised if necessary. At the same time the program and planning authority are taken part and possible procedure problems are discussed.

Conclusion

After conclusion the ROV does not become obligatory. It has then only a gutachterlichen character in principle can it 3 possible exits give:

  • The project corresponds to the requirements of the area planning and regional planning. There are no problems during the conversion.
  • The project does not correspond to the requirements of the area planning and regional planning. As alternative now a so-called goal discrepancy procedure can be only aimed at on initiative of the policy.
  • The project corresponds to the requirements of the area planning and regional planning with measure gifts. In this case editions, e.g. compensation measures or noise protection measures are placed to the agency responsible for the project.
