The certificate of competency (also specialcustomer-oh-point) is the proof that a person for a certain activity is qualified. I.e. the person fulfills by its client and/or superior or a requirement fixed by the law and/or standard giver, those according to the state of the art and/or the rules valid in a discipline to implement is usually sufficient around an activity surely i.e. a desired result to produce and an unwanted exclude.

Frequently the certificates of competency are connected with a theoretical and practical examination.

With physicians and pharmacists the certificate of competency license to practise medicine is called and is as e.g. with teachers and lawyers connected with the state examination.

The most well-known certificate of competency is the driving licence. In addition, there are still driving licences for other vehicles (e.g. Stacker light for floors conveyance) and machines (e.g. Operator lights).

Also the "“welder light"” is a certificate of competency. It is to prevent the fact that a welder makes errors with safety-relevant welding seams and must therefore in regular intervals is repeated.

From above definition result mehrer problems:

• Certificates of competency have also a "“political"” dimension, since they draw partially extensive conclusions for the concerning, liability risk, liability based on fault etc. and in addition not for all "“possible"” ranges meaningful certificate of competency to be required, e.g. with "“general permissions"” (that would be, as if it would give only one driving licence for all vehicles).
• The state of the art is not a really seizable condition, since technical processes can develop constantly further and exist over differently to techniques different opinions.
• In many contracts the capabilities are not explicitly firmly put to recordings and it to exist no over it, e.g. if the boss says to a worker: "“drive times the machine there away"”
• The contract extent can make sometimes higher demands, than they are taken off by the certificate of competency

All these cases can be clarified only with a Rechststreit. It goes could have recognized the problem mainly around the question, the client or the qualified person (technical and/or expert) and those in each case different party to it to refer have. With all cases with those personal injuries arose, this question by the public prosecutor are clarified.
