The certificate of fiction is provisional confirmation of the legal Fikton ("“is considered as permitted"”), if someone a residence title requests, but on it is not yet decided. It is issued after "§ 81 (5) residence law (AufenthG) the applicant, who places a request for distribution or for extension.

If it is at the time of the filing of an application legally in Germany, its stay is considered as permitted, until the foreigner authority decided on its request. If the residence title already ran off and if the request is late placed, the deportation up to the decision is considered as suspended.
