The chemical law of the German Federal Republic regulates among other things the announcing, test and if necessary the marking obligations and thus the chemical registration with new materials.

New materials are all materials, which are not registered in the European old material listing (EINECS).

New materials are registered in the ELINCS listing.

Not all new materials are subject to the announcing obligation, exceptions are annually possible for polymers, for materials in the scientific research, for materials in the procedure-oriented research and development and with quantities under 10 kg.

The chemical law plans registrations for each new material, which is marketed in quantities of more than 10 kg per year and more in gradated form:

  • Gradations:
  • 10 kg up to < 100 kg in circulation quantity brought per year
  • 100 kg up to < 1,000 kg in circulation quantity brought per year, or = 500 kg altogether in circulation quantity brought
  • = 1,000 kg in circulation quantity brought per year, or = 5,000 kg altogether in circulation quantity brought
  • = 10,000 kg in circulation quantity brought per year, or = 50,000 kg altogether in circulation quantity brought
  • = 100,000 kg in circulation quantity brought per year, or = 500,000 kg altogether in circulation quantity brought
  • = 1.000.000 kg in circulation quantity brought per year, or = 5.000.000 kg altogether in circulation quantity brought.

According to this gradation the reporting kinds fixed in the chemical law must be kept and - periods.

Some countries have likewise special chemical inventories, are contained a material, then this material may be brought in circulation. If the material is not contained, then it must not be used over a registration proceedings (registration) taken up to the respective inventory and/or may not otherwise.

  • ENCS (MITI)--Japanese Existing and new Chemical Substances
  • PICCS--Phillipines Inventory OF chemicals and Chemical Substances
  • TSCA--US Toxic Substances control act.
  • SWISS--Poison list 1
  • SWISS--Inventory OF Notified new Substances.
