The clearing obligation is an obligation of persons to make a contribution to winter services on public ways.

To the private property applies: The ways to entry door, bell, mail box and garbage can must be free from 7 to 20 o'clock (judgement of the LG Cologne, Az.: 1 S 3/94).

The exact extent results from the road cleaning statute of the municipality. All the same whether employed, old, ill or frail, which must ensure owners that before the house nobody hurts itself. Who in addition able is not, agency must organize itself, thus also for employed tenants (these take over usually the task). This concerns a duty to safeguard traffic. If the clearing obligation is not considered, perhaps the requiring one is responsible for the consequences of accidents of persons, resulting from it.

In strong snow must be vacated several times. Usually however only, after it stopped to snow. Ice surfaces must be broken and removed. If these resulted from ice rains, one has 40 min time (judgement of the OLG Schleswig Az after end of the rain.: 11 U 14/00).
