Corruption fight
Focused on the fight against corruption so far in Germany classical-proves particularly from (punishing) legal perspective. Ever more are employed however also in other technical disciplines considerations, in which way stop can be ordered to the various corruption phenomena.
Problems
Corruption is promoted by different circumstances (and/or its fight obstructs):
- The influencing control of the policy on prosecution authorities in restaurant economics against powerful persons, in addition, influencing controls on administrations, in order to reach order assignment to well-known and friendly entrepreneurs, are occupied in several criminal procedures. (Professor Dr. Britta spell mountain, corruption in Germany and its criminal control, Neuwied 2002, page 334).
- Politicians do not have incentive for fighting corruption. They do not want to know rather nothing at all from the topic. Also the injustice consciousness of politicians is not strongly pronounced. On the contrary, some regard "commissions "as a legitimate part of their income. (Dr. Regina see, upper state attorney in Munich, in restaurant ethics economics No. 2005-2 of Ingo Pies, Peter sat, Henry Meyer to Schwabedissen, prevention of white-collar crime, for the theory and practice of the corruption fight).).
- Politicians are not resistant only to give themselves and these subject corruption rules, it cause themselves also that so some good beginning in the administration was destroyed made. Munich and Frankfurt had the best corruption fight strategies. These however continual promoted cases of corruption to light, so that the impression developed that Frankfurt and Munich would be as only cities centers of the corruption. Politicians, who have the incentive, again to be selected, then the pressure can become too strong by the public reactions, so that they plead for a change (defusing) of the corruption strategies. (Saving CCIT Collisi, German city day, in restaurant ethics economics No. 2005-2 of Ingo Pies, Peter sat, Henry Meyer to Schwabedissen, prevention of white-collar crime, for the theory and practice of the corruption fight).).
- To the question "as state lawyers are independent in "see the lecture of the same name of Dr. Winfried Maier, judge at the OLG Munich, public prosecutor a.D., to Augsburg:
- Control organs (e.g. supervisory boards or law) belong to the same organization as the corrupted ones (e.g. coworkers, managers or officials), and it cover each other
- The involved ones do not have interest in the financial success of the enterprise, but particularly at the personal advantage.
- The "legal corruption" erodes the right feeling.
- The existing criminal law threatens - corrupting as corrupted - with sanctions. However from it also the interest arises for all involved one to mask their dubious actions.
Possibilities
Since 1995 the non-governmental organization (NGO) publishes Transparency international the international corruption index (CPI). The corruption index is a listing, which measures the extent of the perception of corruption in different countries of the earth. The CPI unfolds meanwhile a broad effect in the public, which is thus sensitized for the global problem of the corruption.
In German large cities increasingly so-called emphasis public prosecutor's offices are called against corruption in the life - this before the background that the corruption fight is an extremely complicated venture, which requires a bundling of resources and authority. The public prosecutor's office Munich I maintains to time largest anti-corruption department in Germany. It help the public hand, among other things the city Munich, from 1994 to 2004 to the realization of 46 millions EUR payment of damages - an extent, which documents to that extent meanwhile only the light field of corruption; the actual damage (inclusive Dunkelfeld) goes supposed far beyond that. (Source: Dr. Regina see, upper state attorney and chief of the department XII of the public prosecutor's office Munich I.)
Within the range of the private enterprises increasingly competition-neutral self obligations of individual industries (e.g. in the building industry) are initiated. These sit down the collective goal of giving to the corruption in the course of a comprehensive ethics management a refusal. Also the restaurant ethics/enterprise ethics is concerned in more recent time particularly with options of corruption prevention and - fight. As example to that extent the scientific publication of Pies is et al. to call: Prevention of white-collar crime - to the theory and practice,/Wittenberg resounds to the corruption fight 2005).
First beginnings of an explicit anti-corruption management do not exist last also for the public administration. For instance the work of fist ("organization culture and ethics supplies theoretical bases from view of the administrative ethics: Perspectives for public administrations", Berlin 2003). Conceptions for the administrative practice were presented with the Speyerer quality competition 2005: Here the office for district Berlin Spandau for its innovative anti-corruption beginning received a
