The dangerous material regulation (GefStoffV) is a regulation to the protection from dangerous materials (dangerous materials) in the German industrial safety. The regulation authorization is contained in the chemical law (ChemG). Since 2005 also the industrial safety law is legal basis for the GefStoffV.

The dangerous material regulation was already compiled 1983 and issued for the first time 1986. Since then it was several times changed:

  • 1993 by the decree of an independent chemical prohibition regulation
  • 1999 by the introduction of the sliding reference technology for EEC domestic market guidelines.
  • 2004 in recent amending (December 2004) were fundamentally revised the dangerous material regulation. On 29 December 2004 in the federal law gazette published new dangerous material regulation came into force on 1 January 2005 and serves in particular the conversion of the EEC guideline 98/24/EG (dangerous material guideline) into German right. An important innovation in relation to the old dangerous material regulation is the new endangerment evaluation and the protection stage model. With the entry into force of the dangerous material regulation 2005 a new health-based limit value concept was introduced. Therefore have in the TRGS 900 led technical arranging concentrations (TRK values) no more legal basis. All remaining limit values (health-based MAK values) are continued to use up to the appearance of the new TRGS 900. These are proven as AGW values (job limit values).

During the endangerment evaluation are endangerments

  • by physicochemical characteristics (in particular fire and dangers of explosion)
  • by toxic characteristics and
  • by special characteristics in connection with certain activities

to judge independently.

on the basis of the marking of the dangerous material the work with dangerous materials is divided in four protection stages (protection conception of levels):

  • Protection stage 1: Minimum-took
  • Protection stage 2: Standard protection stage for activities with dangerous materials
  • Protection stage 3: Additional application with work with poisonous and very poisonous materials
  • Protection stage 4: Additional application with work with carcinogenic, hereditarygood-changing and fertility-damaging materials (CMR materials).

From it certain massnahmenpakete for the employer/entrepreneur, which refer also to the examination of the effectiveness of met technical preventive measures, result:

  • Protection stage 1: Examination of the effectiveness of technical measures (at least every 3 years)
  • Protection stage 2: Measurement or equivalent evaluation procedure
  • Protection stage 3: Measurement or equivalent checking methods
  • Protection stage 4: Measurements, in particular for the early determination of increased expositions due to an unexpected event or an accident

It is only meaningful to assign measuring points in accordance with "§ 9 exp. 6 GefStoffV to which applies:

  • Technical instruction and necessary mechanisms
  • accredited measuring point (so far: "„of the countries measuring point recognized "“)
  • Protection stage 1 applies to attractive (Xi), to injurious to health (Xn) and to corrosive (C) of dangerous materials with low exposition, if the measures of the protection stage 1 (TRGS 500) are sufficient.
  • Protection stage 2 applies additionally to the same dangerous materials with higher exposition, if protection stage 1 is not sufficient after the result of an endangerment evaluation any longer.
  • Protection stage 3 seizes additionally, if very poisonous (T+) and poisonous (T) dangerous materials are involved.
  • Protection stage 4 applies additionally, if cancer-producing, hereditarygood-changing and fertility-damaging dangerous materials (category 1 or 2) are used.

Range of application - "§1 GefStoffV

  • for all dangerous materials and preparing in the sense "§ of the 3a (1) ChemG and for those, which possess other chronically damaging characteristics, or are combustible
  • Materials, preparing and products, which would be to be marked 76/769/EWG, 96/59/EG or 1999/45/EG after the guidelines additionally
  • Biocide products, those not the danger characteristics to exhibit and biological working materials, which are in circulation brought as biocide
  • Restrictions are to be examined on the basis "§ 1 (2) to (5) GefStoffV in individual cases: e.g. GefStoffV does not apply to biological working materials, the prohibitions to certain chemicals and the rules to handling dangerous materials applies not for Untertage and in households.
  • In the case of doubt applies: An employee must work with a dangerous material or a dangerous material must commercially in circulation be brought.
  • Exceptions after "§ 20 (1) GefStoffV by the responsible authority on written request in just as effective measures or with a not reasonable hardness. After "§ 20 (2) GefStoffV no marking for the Inverkehrbringen with small quantity without endangerment and not high-inflammatory, explosion-dangerously, corrosive, biocide or CMR material

Definition - "§3 GefStoffV
