The term of dual system designates a system acting after "§ 6 exp. 3 of the packing regulation for the collection and utilization of sales packing. This private-economically operated system exists apart from the normal local disposal. Therefore the name of "“dual"” system.

With the disposal of sales packing special regulations apply after "§ 6 VerpackV. Each manufacturer and Vertreiber of sales packing are obligated in principle to it, of the final consumer used, remainder-emptied sales packing back at the place of the actual delivery or in its direct proximity free of charge to take. If manufacturers and Vertreiber of sales packing fulfill this original obligation, they are considered as Selbstentsorger. In contrast to this stands the alternative regulated in "§ 6 exp. 3 sentence 1 VerpackV to free itself from this obligation to by itself the manufacturers or Vertreiber at a binary system i.S.d. "§ 6 exp. 3 VerpackV take part.

These binary systems are subject therefore to special legal requirements. So the system must e.g.:

• • a regular collection ensure,
  • surface covering (i.e. in a Land of the Federal Republic) to be operated,
  • officially determined its,
  • the utilization ratios prescribed in appendix I No. 1 VerpackV fulfill,
  • the disposal achievements needed by it publicly write out.

Zurzeit exists in Germany only a country wide of dual system. This is led by the dual system Germany GmbH. Besides it gives still such as land Bell AG and Interseroh AG, which win increasingly market shares to companies and which attack monopoly-like position of the DSD GmbH.
