As evening baking ban became a legal regulation admits, which forbade the work in baker's shops and confectioneries to certain nighttimes.

The evening baking ban goes back on the proclamation over preparing of baking goods of the Upper House of Parliament from 5 January 1915, in which it meant in "§ 9: "„All work, which serves for preparing of baking goods, is in baker's shops and confectioneries, even if these represent only one subsidiary establishment, in which to time of 7 o'clock in the evening to 7 o'clock in the morning forbidden. "“This regulation was transferred also to the regulation of the people-assigned over the work time to baker's shops and confectioneries from 23 November 1918 (realm law gazette P. 1329). On constitutional complaint of a baker master the Federal Constitutional Court decided in the year 1968, the restriction of the occupation liberty by the evening baking ban is condition in accordance with (see BVerfGE 23, 50 - evening baking ban I).

The last valid regulations to the evening baking ban are based on the law passed by the German Bundestag for the change of the law over the work time in baker's shops and confectioneries from 23 July 1969 (BGBl. I P. 937). In "§"§ the 5 and 7 of this law it was fixed that in areas, which serve the production of bread, roll and small pastry, in which time was forbidden by 22:00 clock to 4:00 clock any activity and that the baking goods before 5:45 clock could not be delivered. 1976 confirmed the Federal Constitutional Court again the legal standard of the regulation (BVerfGE 41, 360 - evening baking ban II).

With the change of the law regulating the closing time of shops to 1 November 1996 also the work in baker's shops and confectioneries was again regulated. Here apply since then, as also for all other enterprises in Germany, which regulations of the work time law, in which also the night work is regulated. The evening baking ban was waived thereby. An exception for baking enterprises remained existing however: while the period between 23:00 clock and 6:00 clock is defined as nighttime generally, this applies there to the period of 22:00 clock to 5:00 clock.
