The Erstzugriff is based particularly on "§ 163 exp. 1 code of criminal procedure:

"„The authorities and the official of the police service do not have to investigate criminal offences and to give all instructions permitting delay, in order to prevent the collusion of the thing. For this purpose they are authorized to ask all authorities for information to require with danger in the delay also, the information as well as determinations of each kind to make [...] "“

With "“attack"” it is meant that one seizes circumstances and analyzes ("“into the hand takes"”) must.

The first attack begins with the safeguard attack and changes afterwards into the analysis attack.

The safeguard attack is accomplished by the police force arriving first at the event place. The analysis attack can take place via the same forces or in addition, via Kriminalbeamte (those not necessarily final specialists to be to have). Here can be fallen back also to special specialists (e.g. specialists of the trace safety device). The analysis attack ends, if the procedure is finalspecialworked on, i.e. one to the public prosecutor's office.

The first attack is crucially direct for determination success and thus for the clearing-up ratio, since a large part of the determination beginnings on the won realizations of the first attack found.

The police regulation No. 100 is relevant.
