The fiscal auxiliary business marks a Unterfall of acquisition-economical acting of the administration. Meant thereby the satisfaction of requirements is for the fulfilment of the actual tasks, thus the procurement of the necessary materials (from office products to buildings). The state participates like an entrepreneur in the economic life. Therefore also regulations of private law apply, responsibly are the civil courts in constant iurisdiction. Contentious it is however, in particular in the legal teachings to what extent private law is publicly overlaid thereby. Is above all the range principle of equality (kind 3 GG) of importance. This applies probably at least in form of the arbitrariness prohibition. Great importance attains the public assignment right anyhow in this connection.
