The international Kodex for the marketing of mother's milk spare products (English internationally code OF marketing OF Breast milk substitute) http://www.who.int/nutrition/publications/code_english.pdf was discharged 1981 by the world health meeting (WHA). The Kodex requires that the marketing is limited by spare products for mother's milk. Thus it is to be achieved that mothers are not held from satisfying and spare products for mother's milk without health endangerment for the baby are used.
Into the 1970er-Jahren it was stated that satisfying decreased world-wide. The mother's milk was replaced by industrially manufactured baby food. Health specialists were anxiously over the associated health risks for babies, particularly in third world states. In the acceptance that the decrease of satisfying was connected directly with the marketing practices of the baby food industry, it compiled the WHO together with the UNICEF the "international Kodex for the marketing of mother's milk spare products". It became of the 34. WHA to 21. May 1981 accepted by 118 WHO member states. Only the USA was against it. It had used itself already in the apron actively for the fact that the Kodex was issued only in the form of a recommendation.
The conversion and adherence to the Kodexes by international organizations and non-governmental organizations one criticized. In the consequence the WHA issued eleven resolutions in 25 years for concretizing the Kodexes. The most important were issued 1994 (restrictions of the free delivery), 1996 (avoidance of interest conflicts) and 2001 (exclusive satisfying in the first 6 months). These resolutions have the same, non-obligatory right status as the Kodex. They proceed meanwhile, because they are more special or were accepted temporally later, the Kodex of 1981.
The Kodex contains the minimum requirements for a healthy baby and baby food. The states are requested to transfer their regulations completely to the national legislation.
The Kodex cannot be interspersed with legal instruments. National sanctions because of offences against the Kodex are only intended, where it was embodied into the national legislation. 1990 were only in nine states legally converted the Kodex. 2005 gave it more to than 60 states, which had transferred the Kodex or parts of it to the national right.
On private basis the non-governmental organization supervises "internationally baby Food Action network (IBFAN)" the adherence to the Kodexes. It reports regularly on the offences in the individual countries. If published offences decreased in the last years, are however further frequent.
The topic of the yearly 2006 of the world quiet week is dedicated to the Kodex and reads: "To the protection of satisfying ": 25 years international Kodex for the marketing of mother's milk spare products. The world quiet week is the largest common action of all quiet-promoting organizations. She is committed each year in over 120 countries.
