Inventions are special, on the hand not lying, material Konstrukte or procedure, which makes new and useful applications possible. They are invented by inventors.

Invention and discovery

The terms invention and discovery are often confounded, although they mean completely different things. A discovery concerns somewhat at present the discovery already existing, which was unknown however so far. Thus however due to the discovery nothing changed (except the associated knowledge increase of a particular or the public). Thus we speak an invention of the discovery of the force of gravity, a Planetoiden, a chemical material, an animal species etc. against it always concern something that Trade Union of German Employees nature is so far not. This thing stands however with already well-known one in a connection, it arises not as somewhat completely new. At well-known things changes are made, so that their effect is improved qualitatively or quantitatively.

Today one bends to refer inventions only to material and abstract things, as e.g. the invention of a new verse measure to exclude from the inventions.

First inventions

The nature human being already made the first inventions. They concerned in particular tools, which had a better use from arm and hand to the consequence. After humans had made the discovery that a stone in the hand increased the effect of the arm, it could give a special form to the stone, in order to increase its impact. That led to the invention of the stone axe.

Inventing

Inventing is to be understood neither as art nor as science. To be offered the mental ability of problems is a solution for it to be recognized and. Each humans are an inventor. From well-known or famous inventors often only the will and the penetration strength an idea up to a finished product differentiate many to pursue.

Effect of inventions

One speaks of large inventions, if they draw many smaller inventions, which are used later in the everyday life or at all generally admit become. But large inventions are noticed not always immediately as such. Thus the steam engine existed still seven years after its invention as only copy, and it took 30 years, before it was industrially built in improved execution.

Patentable inventions

A patentable invention is one

• commercially applicable,
• new,
• not obvious theory to
• technical acting, i.e.
  • an instruction for the employment of controllable natural forces for the direct reaching of a causally surveyable success

Not patentable inventions

In contrast to it the discovery, thus finding something, stands which is already before Trade Union of German Employees nature and is not patentable, e.g. the discovery of an animal species or a continent. Just as little scientific theories, physical laws or mathematical models as inventions are regarded; also they are discovered.

Further mental-creative (speak creative) works (see for this copyright), as for instance literature, music or art as invention are not classified.

Computer programs as such are not (according to this definition) even in the repeated sense patentable inventions. Differently this looks, if the computer program is used for the control of natural forces (e.g. Airbag, electronic motor control). The exact demarcation is very controversially discussed at present (see in addition software patents).

The legal term invention is not under any circumstances congruent with the term of the innovation, although in the political discourse these terms are frequently mixed.

In the European patent convention in article 52 the exclusions are specified by the patentrechtlichen invention term.
