By a mandate (given by Latin ex manu date "„from the hand "“) one understands the order for agency, which a mandator gives to his attorney in the right nature. Mandates are imperativ "„"“: The attorney is obligated to his mandator to represent excluding the interests and can during offence to the account be pulled. A mandate in similar sense lies also in the hands of the selected work council. This is not bound at instructions of the staff or to resolutions of the workshop meeting. Also no compelling connection of the work council at trade unions exists, a trusting co-operation is only required.
