The market right was the right of a municipality to organize markets and mostly became together with the municipal law, in addition, lent without this. Inhabitants of a market town held this right, foreigner could it temporally reduced acquire. With the market right the citizen right, which brought among other things the privilege to a better legal status and a lower control item with itself, in a market town was connected. With the receipt of the market right also the choice of a market judge was connected. This ensured with its assistants for the fact that it came to no palpablenesses at the market, or to tumults in the pubs. Because the market right permitted the holding of at least a fair and of weekly markets, with which regularly large crush prevailed, since numerous craftsmen and dealer offered their goods for sale.
Localities with market right had to be recognizable during the market times also as such. In addition different outside characteristics served, like for example flags or with indications and symbols provided stone columns depending upon region. These were set up before the entries to the market place, which was to be entered usually through lockable gates or gates.
The market right was issued the localities by the emperor/king of the holy Roman realm of German nation. Was introduced the market right in an administrative reform Heinrichs IV., which lent 1016 the Marienstift as the first pin in the German Reich and the market right.
The market right had again to be confirmed with start of each new national prince, for which a certain money had to be paid off.
After the market right is not today otherwise regulated (in principle each municipality can hold markets), has the designation "market" a special contentwise meaning more. In Bavaria however larger circle-belonging municipalities on their request can be explained also today still by the federal state government officially as the "market". The Bavarian local legislation differentiates to that extent at municipalities circle-belonging between cities, markets and municipalities. "Market municipality" there is not the term in Bavaria. Basis is an appropriate regulation in the Gemeindeordnung for the Free State of Bavaria. Here it means in article 3:
For the award of the title "market" thus certain conditions are necessary. In particular a special or paramount meaning in relation to the surrounding municipalities in cultural, economic or historical regard. One can classify the markets under Bavaria quasi between the cities on the one hand and the other municipalities circle-belonging on the other hand.
In Austria and in South Tyrol the award of the title "market municipality" is similarly regulated. Both in Austria and in Bavaria it comes isolated forwards that the term "market" is an official component of the municipality name, e.g. into Bavaria market Berolzheim, market Bibart, market a home, market Erlbach, market forest, into Austria market Piesting or Aschbach market, Aspang market or the principal place of a greater, like Ardagger market.
A title without right means that it does not have any practical meaning today in the principle more, whether a municipality may call itself as market municipality or not. If a municipality liked to organize a market, a weekly market, a flea market, fair or a world exhibition, other criteria apply. The title market municipality is for this no condition. It is above all a decoration work for location marketing and for the public work of the municipality and has in Bavaria and Austria, where tradition enjoys still another high value, quite its place.
Switzerland does not know these designations, however some, also quite small Swiss of places, in the Middle Ages to cities and/or to small market towns was already raised. Although many places until today are perhaps still village small, "small town" calls itself proudly as city to today some Swiss.
