By municipality planning one understands the foresighted organization and development of the area of one municipality they represents usually the lowest level within the building of stages of the space planning, which is accomplished by public places (European union, federation, countries, bodies on regional level such as regional federations, circles or districts, municipalities).

In the context of municipality planning goals for the spatial development are to be defined e.g. concerning land development, landscape or traffic, which are to be converted by appropriate measures. For this among other things the instruments of the building zoning plan stand for order, in those the use of surfaces surface dedication plan) within the Gemeindegebietes are e.g. specified or the measure and the shape of the future land development (development plan). Beside these order instruments however also development instruments are like e.g. Promotions of certain uses (local supply), investments etc. as measures of municipality planning possible.

Municipality planning in Austria

In Austria municipality planning (local space planning) is according to Federal Constitution a task in the own effective range of the municipalities. These are autonomous and not to other regional administrative bodies instruction therefore in their decisions. However a supervision exists by the respective federal state governments, which can waive or malfunction regulations of the municipalities, if the valid legislation (regional planning laws) were not kept. In addition the obligation exists to take and these not contradict for definitions of over-local planning authorities (e.g. within the ranges regional planning, water law, federal highways) consideration in the context of the local space planning.

Since space planning generally falls into the authority of the countries and can to the difference to Germany also no framework legislation via the federation take place, there are nine different regional planning laws, which lead in their systematics to similar conditions for the local space planning, in the detail to exhibit however nevertheless very differently regulations. This concerns v. A. the designation and definition of certain contents (e.g. Development land categories), which deviate often strongly from each other and lead from large vagueness within the federal territory.

As instruments of municipality planning all Austrian regional planning laws know:

  • local development concept (or spatial development concept, local regional planning program etc.)
  • Surface dedication plan
  • Development plan (and/or land development guidelines)
