The own establishment represents an organization possibility of a local enterprise. It is a special public form of business organization, on the basis of the Gemeindeordnungen and/or the circle orders of the Lands of the Federal Republic. It does not have an own juridical personality, but represents a separated special estate and is organizational and financialeconomically separated from the respective local administration. Outward the legal actions of the respective own establishment of the respective municipality are added.

The legal bases of the own establishment are out-arranged and by the municipalities in business regulations are concretized in each case in the own establishment laws and/or own establishment regulations of the Lands of the Federal Republic more near. Own establishment may be only created, if the local commercial law of the respective Gemeindeordnung permits an economic manipulation of the municipality.

For the own establishment usually is a production management (also: To order work line) and an operating committee or a work committee). Are incumbent on the production management the current management, the agency of the enterprise and carrying out of resolutions of the operating committee, to which certain competencies are assigned. Since the own establishment possesses legally no own juridical personality, and which actions of the respective own establishment of the municipality are added, the respective local council is responsible and/or for fundamental legal transactions the respective head office official (for example mayors) for fundamental decisions.

According to the of the own establishment as local special estate, this is led not in the local household. The own establishment sets up its own economic plan. This consists of the success plan (running costs), the fortune plan (investments of the Betreibes) and the place overview (which places are occupied in the own establishment).
