The local planning competence covers the right of the regional administrative bodies to arrange the respective development concerning town construction solely responsible in the context of the building zoning plan. Among this right also planning for local mechanisms ranks such as school development plan or kindergarten plan. Since the legal bases are essentially specified for instance to the building zoning plan by the federation and/or the respective Land of the Federal Republic, these levels can specify the range of the local planning competence also. The constitutional warranty of the local autonomy puts to that extent a latch plate for that forward, when a basic existence of planning must be able to be regulated solely responsible by the municipalities and so that a complete withdrawal is impossible.

From the right follow the local planning competence far rights of information, hearing rights and participation rights of the municipalities with superordinate special plannings. For example a municipality is with the building of a federal motorway, which runs over its area to take part compellingly and to consider the gemeindlichen interests in the special planning compellingly. Also the area planning plans of the countries have the local building zoning plan to consider (countercurrent principle).
