Provisional housekeeping or emergency housekeeping one calls the continuation of the state activity without a valid budgetary law.

Principle of the budget sovereignty

In parliamentary democracies in principle the parliaments have the budget sovereignty, thus the right, the public expenditures and - took to specify. They alone have to decide the right, which loads the state imposes upon to its citizen and how it deals with in such a way taken means. The legislator in mostly for one year the valid budgetary law meets the appropriate definitions.

If one follows the principle of the budget sovereignty of the parliament without restrictions, the state would have to stop its activity perfectly, if at expiration of the validity period of the old budgetary law no new stepped into force. So no wages might be paid off and no calculations be settled. Beyond that the state in addition, no new liabilities might be received. It would have to thus send its persons employed home and close all state institutions. The rules for provisional housekeeping serve to avoid the associated collapse of the state.

Regulations in individual countries

In the Federal Republic of Germany both to the federation and to the countries in favor of the executive quite far regulations apply. For the federation kind 111 Basic Law plans the right for provisional housekeeping. The Federal Government can make expenditures to limited extent and take up credits. This applies only to expenditures "„those is necessary,

  1. in order legally existing mechanisms to receive and legally decided measures to accomplish,
  2. in order to fulfill the legally justified obligations of the federation,
  3. in order to continue buildings, procurements and other achievements or to grant aids for these purposes further, if by the budget of one previous year already amounts were granted.

In Austria kind regulates 51 exp. 5 of the Federal Constitution the provisional housekeeping: Public expenditures "„are,

  1. if the Federal Government submitted the draft of a federal financial law, up to the entry into force of a legal regulation, however at the latest during the first four months of the following financial year to carry out in accordance with this draft;
  2. if the Federal Government did not submit a draft of a federal financial law or if in case of Z 1 the first four months of the following financial year ran off to carry out in accordance with the expenditure beginnings contained in the last federal financial law.

In the USA only absolutely unavoidable expenditures of the federation without valid household are permissible. There therefore in case of a budget conflict a majority of the federal authorities is closed.
