The telecommunication service enterprise data security regulation was a regulation of the German Federal Government, in which the protection of personal data was regulated by telecommunications offerers. It had been issued in the year 1996 on basis of the postal service and telecommunications adjustment law and replaced the Telekom data security regulation as well as the Teledienstunternehmen Datenschutzverordnung. It stepped to 19 December 2000 repealed and by the telecommunications data security regulation was replaced.

Regulation range

One specified, which connecting data could be stored by service tenderers - thus the German Telekom and its competitors - and when they were to be deleted again. Also regulations were to the single connecting proof, for call number transmission as well as to directory entries and the telephone information.

Innovations

Contrary to the predecessor regulations it made the TDSV for the customer possible now to prevent an entry of its call number into electronic customer listings such as CD-ROM or the Internet however further in the printed directory to appear ("§ 10 exp. 3). Likewise the number could be passed on over the telephone information in case of a Nichteintrags, if the customer wished this. The inverse search was expressly forbidden to the information ("§ 11 exp. 5).

In addition it was specified that the telecommunications enterprises had to make their customer possible free of charge the suppression of the call number transmission ("§ 9 exp. 1)

Criticism

Fundamental criticism to the TDSV came from data-security commissioners. These criticized that the data security in the telecommunications is regulated only by a ministerial regulation. Instead a parliamentary law is appropriate. Only by the telecommunications law of 2004 was considered to this demand.

In addition the authorization basis of the TDSV - "§ 10 postal service and telecommunications adjustment law - was already set 1997 repealed. Thus contradictions would have opened themselves between the away-valid TDSV and the telecommunications law of 1996.
