The travel document of identification for refugees is a passport replacement, which is issued to a refugee in the sense that Geneva refugee convention (GRP). Legal basis is article 28 GRP. Exhibition reason is that protection is granted to the refugee before pursuit measures in the origin state and it it therefore is unreasonable, to take shelter to the protection of this state by being able to be issued from this State of a regular passport.
Exhibition modalities and use
The exhibition modalities for travel documents of identification for refugees are more near regulated in the appendix to GRP. Afterwards applies among other things:
- The travel document of identification is to be drawn up in at least two languages and anyhow in English or French.
- In him can be specified children with.
- The fees for the exhibition may not be higher than for regular passports, which the exhibitor state spends to own citizens.
- Except in special cases the travel document of identification is to be world-wide valid.
- It is issued for or two years.
- The new exhibition and extension take place via the exhibitor state of the past document of identification. If however the owner in another state established itself and there permitted lives, the competence turns into on the new receiving state. This draws in the old travel document of identification for refugees and sends it back either to the exhibitor state or destroys it.
- For this authorized representations abroad of an exhibitor state can extend the travel documents of identification for a half year.
- The Contracting States of GRP must recognize the travel documents of identification for refugees of other Contracting States in principle.
- In the travel document of identification for refugees visas can be attached.
- If a visa of a goal state is present, through journey countries are to issue transit visas, if no reason for refusing is present.
- For the visas no fees may be required, which the minimum charge sets for visas, which are issued at foreigners, to exceed.
- Each exhibitor state must take the owner back during the period of validity of the travel document of identification for refugees again; Visas and other may be required however.
- The travel document of identification for refugees obtain no diplomatic and consular protection.
Further international-law regulations; Schengen right
The European convention over the abolition of the visa obligation for refugees from 20 April 1959, a Council of Europe agreement, plans the visa liberty of the refugees, who travel with travel documents of identification of the Contracting Parties.
Contracting Parties are at present: Belgium, Denmark, Finland, France, Ireland, Iceland, Italy, Liechtenstein, Luxembourg, Malta, the Netherlands, Norway, Poland, Portugal, Romania, Sweden, Switzerland, Slowakei, Spain, Czech republic and the united kingdom. France and the united kingdom ratified the convention, but in the meantime according to a clause, which permits this, explains, not to want to use it until further notice any longer.
Between Switzerland and the Federal Republic of Germany an agreement with similar objective was closed (agreements between the government of the Federal Republic of Germany and the Swiss Upper House of Parliament over the abolishment of the visa obligation for refugees of 4. May 1961; BGBl. 1962 II P. 2331, 2332).
Regarding the visa obligation for stay of up to three months in the half-year it applies to owners of refugee passports in the Schengen states otherwise that it
- visa obligation are subject, if the exhibitor state of the document of identification, in which they are, is specified in the list of the visa-requiring states,
- that they can be released however from the visa obligation by the individual Schengen states, if this state is specified in the list of the visa-free states.

German right
- Foreign travel documents of identification for refugees, who were issued after that Geneva refugee convention (thus of Contracting States), are easily certified as passport replacement in Germany ("§ 3 exp. 3 No. 1, "§ 1 exp. 3 of the residence regulation (AufenthV)).
- Owners foreign travel documents of identification for foreigners are released for the entry and the short stay from the requirement of a visa and/or a residence title, if the document of identification of an EUROPEAN UNION or contains a EWR state, which is issued Switzerland or a visa-free state, the travel document of identification a return authorization, which is valid still four months starting from the day of the entry, and no gainful employment in the residencelegal sense is to be exercised ("§ 18 sentence 1 AufenthV). The four-period of one month does not apply to the states, in which the European convention over the abolition of the visa obligation for refugees from 20 April 1959 application finds ("§ 18 sentence 2 AufenthV).
- German travel documents of identification for refugees are passport spare papers ("§ 4 exp. 1 No. 4 AufenthV). They are usually extracted, if the conditions for exhibition are not present any longer ("§ 4 exp. 2 AufenthV).
- The samples the German travel documents of identification for refugees are fixed in the plant D7 for residence regulation; see also "§ 58 No. 7 AufenthV.
- For the exhibition 1 AufenthV becomes 30 euro after "§ 48 No., for which after "§ 48 No. 2 AufenthV 20 euro raised extension at fee.
